Rhea Chakraborty Asks Bombay High Court To Not Dismiss FIR Against Sushant Singh's Sisters

Chakraborty in an affidavit filed through her lawyer Satish Maneshinde said that fabricated and forged medical prescription was used to assist Rajput in procuring medicines that are banned under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

Actor Rhea Chakraborty on Tuesday filed an affidavit in the Bombay High Court to dismiss the plea of Sushant Singh Rajput's sisters for quashing FIR lodged against them. The FIR was filed on basis of accusations that they had procured a fake medical prescription for their brother. Rajput's sisters have asked to court to dismiss the case, also requesting the court to ask the Central Bureau of Investigation to not take any coercive steps against them.

Rhea Chakraborty requested the Bombay High Court to dismiss their plea citing that the allegations against Sushant Singh Rajput's sisters Priyanka and Meetu Singh are serious. Moreover, Chakraborty said that as the probe is in the initial stage, and thus time should be given to the agency for its investigation.

In the affidavit filed through her lawyer Satish Maneshinde, Chakraborty said that fabricated and forged medical prescription was used to assist Rajput in procuring medicines that are banned under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, reported NDTV.

"Rajput died merely five days after he obtained the said prescription, wherein he was unlawfully prescribed psychotropic substances at the behest of his sister (Priyanka) and Dr. Tarun Kumar," the affidavit further said. Chakraborty's affidavit also said that the manner in which the medications were prescribed was a violation of the Indian Medical Council regulations.

The petition was taken up by a division bench of Justices MS Karnik and SS Shinde. The bench has scheduled next hearing for the petition on November 4,2o20 after both Mumbai Police and the CBI sought time to file their affidavits.

The Bandra police lodged an FIR on September 7 against Rajput's sisters and Dr Tarun Kumar, from Delhi's Ram Manohar Lohia Hospital, who reportedly  signed the medical prescription.

Sushant's Sisters' Petition

Priyanka Singh and Meetu Singh in their petition filed through their lawyer Madhav Thorat, dated October 6, sought the case to be quashed and by way of interim relief requested for a direction to the CBI to not take any coercive steps against them. They have claimed in their petition that the medicine they procured for their brother is not banned citing the guidelines issued by the Medical Council of India (MCI) on April 11, for telemedicine, which “allows the medicine to be prescribed to a patient even at the first consultation," HT reported.

Their petition also relied on a previous 2005 Supreme Court judgement in Jacob Matthew’s case. In this case, the apex court had held that no offence against a medical practitioner can be investigated without first obtaining the opinion of experts in the medical field.

Fearing that they could be arrested by CBI any moment, Sushant Singh's sisters have requested the Bombay HC for an early hearing of their petition, reports India Today.

34-year-old Rajput was found dead on 14 June 2020 at his residence located in suburban Bandra. A CBI investigation is underway in his death, and Narcotics Control Bureau is conducting a drug probe as well.
