His colleague and co-accused, Khushi Sahjwani, was granted bail in July, by the apex court, after which Tamhankar had applied for bail on the grounds of parity. The court, however, rejected his plea saying that the offence was very serious and that there was strong technical evidence against him in the case.

Tamhankar was represented by advocate Sandeep Karnik, who argued that the 42-year-old was jailed on May 5, 2018. The prosecution is pursuing a case on a DNA sample collected from Sahjwani's car, two months after the incident in March 2018. Karnik alleged that undue weightage was given to the CCTV footage where Vyas can be seen near the car.

According to a report, he added that there was no apparent witness to the alleged murder and that there was no evidence of the car stopping at any point. It was thus impossible for Vyas to be killed in a moving car and the body to be moved to the boot of the car. He argued that the non-judicial confession of Sahjwani was not reliable and that there was no dead body found. The co-accused was released on bail when they faced the same charges, thus, making Tamhankar entitled to bail on grounds of parity.

Special public prosecutor AK Chimalkar countered for the state, saying that the other accused was granted bail as she was a woman undertrial prisoner who had to look out for her family conditions. The accused was wasting time filing bail applications when the court was ready for trial. Additional Sessions Judge MG Deshpande then rejecting the bail plea, stating the same.
