Kangana's Posts On Farmers: Actor Won't Face Arrest Till Jan 25, Mumbai Police

The organisations and individuals who filed an FIR against that alleged that Ranaut portrayed the protest as a Khalistani movement in the social media post.

Kangana Ranaut's Posts On Farmers: The Mumbai police said that they won't arrest Kangana Ranaut before January 25, 2022, while appearing before the Bombay High Court in the petition filed by Ranaut on quashing the FIR registered against her by a Sikh organisation at Khar police station. The FIR is about her social media posts on the farmer's protest and linking them to a separatist group.

At the hearing, advocate Rizwan Siddiquee, who represents Kangana Ranaut appealed for the FIR to be quashed. This petition was filed by Ranaut in November. In her plea, she said that the organisation that took objection to her social media post has no legal case in it.

Ranaut's lawyer also argued that to charge someone, an accused must have made offensive comments with the "deliberate and malicious intent" of hurting the sentiments of a community. According to Rizwan, Kangana Ranaut had no such intention.

The next date for the hearing was given by the court as an ad-interim relief to Ranaut. The court said that the further proceedings in the case will take place on January 25.

The complaint was filed by a Sikh organisation in Mumbai against the actor for making social media statements that allegedly portrayed the farmer's movement as the Khalistani movement. The police had charged Ranaut for hurting the religious sentiment of the community.

The FIR against her was filed by a 47-year-old Mumbai-based businessman Amarjeet Singh Sandhu along with Shiromani Akali Dal (SAD) and the Delhi Sikh Gurudwara Management Committee (DSGMC).

Ranaut, in her social media post on November 21, had written, "Khalistani terrorists may be arm twisting the government today...The only women prime minister ne inn ko apni jooti ke neeche crush kiya tha (the only women prime minister who crushed them under her shoes). No matter how much suffering she caused to this nation...she crushed them like mosquitoes at the cost of her own life...Lekin desh ke tukde nahi hone diye (but she didn't let the division of nation happen)."

The court went through this social media post and the bench of Justices Nitin Jamdar and Saran Kotwal said, "Where is the deliberate and malicious intent here? Section 295 says that should be the sole and dominant object."

The court then asked the Mumbai police if they intend to arrest the actor. To which Aruna Pai, the Chief Public Prosecutor responded that the Khar police issued a notice for the actor to appear for questioning and the actor has not responded.

The notice was issued under Section 41A of the CrPC, which is a notice of appearance before a police officer, on December 1.

The counsel representing Kangana Ranaut said that the actor is willing to adhere but is apprehensive about the arrest. Then, the court asked Mumbai Police to make a statement on whether they will or not arrest Kangana.

The Mumbai Police stated that they will wait till the next court hearing, that is on January 25 and not make any arrest in the meantime.

The actor's counsel said that Ranaut will appear on December 22 before the Khar police regarding the probe in the aforementioned FIR.

The actor has many FIRs registered against her for making controversial comments on her social media feed. About her Khalistani comment, she was also summoned by the Peace and Harmony Committee of the Delhi Assembly, which is headed by the Aam Aadmi Party MLA Raghav Chadha.

She was summoned on her communal comments on December 6. Although, she did not show up and asked through a letter for an extension on the personal and professional ground, which was then given to her.
