A month after a 34-year-old woman accused actor Karan Oberoi of raping her, she has been arrested by Oshiwara Police in Mumbai of criminal conspiracy against the actor. On May 25, the woman had said that two people who left with a note asked her to take back the case attacked her. An investigation into the case led the police to find out that the woman had actually planned the whole attack on herself so that Oberoi got negative publicity. This was allegedly all done to defame the actor.

Based on the confession and evidence we have arrested the victim, cannot divulge more information on the matter, senior police inspector Shailesh Pasalwad of Oshiwara police station said, India Today reported.

“We have arrested the woman based on technical evidence and also the confession statements of the four youths and her ex-lawyer… We are collecting more evidence. The woman has been booked under the Indian Penal Code sections for 120 (B) (criminal conspiracy), 182 (false information, with intent to cause public servant to use his lawful power to the injury of another person) and 203 (giving false information),” he told TOI.

In the second FIR on May 25, she alleged that she was attacked in the morning by two bike-borne men with a paper cutter knife who gave her a chit with “Take the case back” written on it.

The woman’s lawyer Mansha Bhatia has sought bail for her and told the media, “As my client had nothing to hide, we never felt the need to seek anticipatory bail. She has always cooperated with the police and always been upfront and fearless while dealing with the case,” she said, adding, “Investigation will soon reveal that my client is a victim and had nothing to do with this matter.”

For the initial investigation, the police arrested two accused from Mira Road, who were distant relatives of woman’s former lawyer Ali Kashif Khan and they divulged that they attacked her because Khan had asked them to stage the attack. They then interrogated Khan in a detailed manner on June 3 who couldn’t hold the truth for long before revealing that he has nothing to do with it as the woman had hatched the plan. Further investigation into the case led them to reveal that even the woman was involved to the plotting.

“We have arrested the woman based on technical evidence and also the confession statements of the four youths and her ex-lawyer… We are collecting more evidence. The woman has been booked under the Indian Penal Code sections for 120 (B) (criminal conspiracy), 182 (false information, with intent to cause public servant to use his lawful power to the injury of another person) and 203 (giving false information),”

On June 5, she wrote to the police denying her lawyer's accusation as “absolutely false”. There was “absolutely no reasons for me to ever do so”… “Even on wrong advice of an advocate,” she had told the police.

Oshiwara Police arrested Oberoi on May 5 after the complaint and he had to spend a month in jail. Bombay HCgranted him bail, after significantly observing that prima facie the chats exchanged between the actor and his rape accuser “casts doubt on the veracity of the FIR (against him).”

Investigation in the second FIR reveals that the complainant herself in connivance with her lawyer and others staged the attack on the complainant, said Justice Mohite-Dere. “In fact, investigation reveals that the complainant herself staged her own attack, the obvious reason being to ensure that the applicant (Oberoi) is not released on bail,” Justice Dere had observed in her order of bail to Oberoi.
