A day after the Unnao rape survivor and her family met with a fatal road accident as her car was struck by a truck, accused BJP MLA Kuldip Sengar and 29 of his associates have been booked in a case of criminal conspiracy, murder and attempt to murder. The girl was travelling in the car to Rae Bareli when the accident took place and in that car were the survivor, her lawyer Mahendra Singh and two of her aunts. While she and her lawyer have been seriously injured and are receiving medical help now, both her aunts died in the accident.

The girl’s uncle filed an FIR after the accident took place and alleged that the lawmaker got the car hit. “I am sure that the car was hit for killing all of them by the BJP MLA and his men,” Mahesh Singh, survivor’s uncle said in his complaint.

The FIR stated that the threats from Sengar and his men increased in the last few months after the Allahabad High Court rejected the request of a co-accused in the rape case for bail.

“It was not an accident but a conspiracy to eliminate all of us,” said the survivor’s mother while talking to reporters.

The uncle also claimed that Sengar often phoned the family of the Unnao teenager, who he allegedly raped two years ago and threatened them, from inside the prison. He also asked them to change their statements in the court “if we wanted to live”, the complaint, filed at Gurubakshganj police station, said. The uncle alleged in the FIR that Sengar called them in front of the policemen posted at the village for security. His men had told the survivor’s family that they would be killed if they don’t settle the case with him.

The survivor’s uncle who has filed the complaint is also serving lifetime imprisonment in Rae Bareli prison in a case of attempt to murder and forgery, filed by Sengar’s brother. The survivor was on her way to meet her uncle when the accident took place.

“FIR has been registered under the Indian Penal Code's sections 302 (murder), 307 (attempt to murder), 506 (criminal intimidation), 120b (criminal conspiracy) against 10 named persons, including the BJP MLA, and 15-20 others,” a police officer said. Apart from Sengar, the FIR also names his brother Manoj Singh Sengar, Vinod Mishra, Haripal Singh, Naveen Singh, Komal Singh, Arun Singh, Gyandendra Singh, Rinku Singh and Awadhesh Singh among his associates in the case.

District Magistrate, Raebareli, Neha Sharma said, “I myself with SP visited the Raebareli jail and met Mahesh Sharma. He had given application for parole and as he is resident of Unnao it has been forwarded to the Unnao DM.”

“He also gave two other applications. One for registration of FIR on which it has already been registered and the other for CBI probe into the matter. This application has been forwarded to Principal Secretary, Home,” Sharma added.

Director-General of Police O P Singh has assured that the UP Police will do a CBI probe into the accident if a request comes through which has already been made by the survivor’s uncle. “The truck was over-speeding and it was raining also. Prima facie, appears to be an accident, but a detailed unbiased probe is on in the matter,” Singh told reporters in Lucknow. “The state government is ready for recommending a CBI probe into the Sunday's mishap in Raebareli if the victim's mother or any relative makes any request in this regard,” Singh added.

The case came to media light when the survivor attempted suicide outside UP CM Yogi Adityanath's house in Lucknow after reportedly facing police apathy and non-compliance as they refused to register her case. After the incident, her father was allegedly beaten up by MLA Sengar's brother Atul Singh and others in the village. He died a few days later in police custody. The UP police transferred the case to CBI in April when Sengar was also apprehended by the police.
