Ukrainian Woman Moves Delhi Court To Find Son, Allegedly Kidnapped By Indian Spouse

The Ukrainian woman, who divorced her Indian spouse in 2021, gained custody of her three-year-old child. In March 2022, her spouse took their son on the pretext of a walk and never returned.

A 40-year-old Ukrainian woman is helplessly looking for her three-year-old child in India because her Indian national spouse has seemingly kidnapped their child and is currently in hiding. The woman who has now moved the Delhi Court is trying everything to bring her son back, who has been missing since March this year. On Wednesday, a division bench in the Delhi High court comprising of Justices Amit Sharma and Siddharth Mridul issued a notice to the Ministry of Home Affairs, Ministry of External Affairs, the CBI, the Delhi Police, and her ex-spouse in the matter. The Court also directed the Delhi government to seek further instructions in the case, listing the matter for November 14.

Ukrainian Woman Son Kidnapped

The woman, who works as a school teacher, submitted documented proof of the police cases against the man. She joined the case hearings via video conference from Ukraine along with her translator. The couple divorced in 2021, and the Ukrainian Court had already granted custody of their child to the mother. However, on March 27, 2022, the man took their little son without the mother's consent, only to never return. She has submitted proof in court alleging that she has heard of his whereabouts in Guwahati and Bihar and that he has been constantly changing locations in India so he is not caught.

The woman alleged that he had taken their Ukraine-born son out for a walk as he had been granted visitation rights. However, she kept waiting for the two to return, but they never did. The woman believes for certain that the man brought his son to Indian after kidnapping him in Ukraine, as per a recent report.

Man's illegal entry into India with a child

Advocate Sravan Kumar filed the plea for the woman, which states that the Indian national man had taken advantage of the war in Ukraine by crossing the border into Moldova, further to Romania, and eventually flying to India after that. The plea states that the man took the child out of Ukraine without his mother’s consent and brought the child back to India illegally.

After listening to the woman’s plea, the Delhi High Court has now instructed the Delhi Police to take immediate action in the case and find the child and his 44-year-old father. During the hearing on a video call, the Court asked her whether she was certain her spouse was in India, to which she replied that she had no doubt about it and that her son could be anywhere presently in the Indian territory. The Court has assured the woman that their foremost priority is to find her son and then listen to her other concerns post that.
