Rajasthan Govt To Recall The Controversial Marriage Registration Bill

The amendment to the Rajasthan Compulsory Marriage Act 2009 had led to protests from oppositions and activists who said that the bill encouraged Child Marriage in the state.

Marriage registration bill Rajasthan: After protests from oppositions and criticism by people, the Rajasthan Government led by Chief Minister Ashok Gehlot recalled the marriage registration bill which allowed the registration of child marriages.

At an event to celebrate the International Day of Girl Child, the Chief Minister of Rajasthan Ashok Gehlot said that the government will request the governor to send back the bill for further scrutiny by the experts.

The amendment to the Rajasthan Compulsory Marriage Act 2009 had led to protest from oppositions and activists who said that the bill encouraged Child Marriage in the state and accused the State government of promoting the same.

Gehlot, in the same event, said that the Supreme Court of India had given an order on registration of all marriages in order to safeguard the legal rights of children born out of wedlock and widows.

While talking about the controversy that erupted after the bill was passed, Gehlot said that it is the pledge of the government to not let child marriages happen in Rajasthan and that there will be no compromise.

He added that the passing of the bill had nothing to do with ego and if the legal team advises against it then the government will not proceed with its amendment.

The Rajasthan Compulsory Marriage Registration (Amendment) Bill 2021 allowed registration of marriage even if the bride and groom had not attained the legal age for it. For women, the legal age is 18 years while for men it is 21 years.

The bill was passed in the Rajasthan Legislative Assembly on September 17 and led many of the members of the legislative assembly from the Bhartiya Janata Party (BJP) to walk out.

The State Parliamentary Affairs Minister Shanti Dhariwal had argued that the proposed legislation allows registration of marriages but does not state that they will be validated after registration. If it is a case of child marriage, then the collector of the particular district will be notified and necessary actions will be taken.
