Delhi HC To Hear Plea Seeking Recovery Of Rs 20 Lakh Cost Imposed On Juhi Chawla

The DSLSA had sought "assistance" by the court by seeking issuance of warrants of attachment and sale of the properties for the recovery or directions for civil imprisonment of Juhi Chawla and others.

The Delhi High Court on being approached by the Delhi State Legal Services Authority (DSLSA) set the date for hearing on Friday 3 regarding the execution of an order seeking Juhi Chawla and two others to deposit ₹ 20 lakh as costs on a lawsuit against the 5G technology.

According to reports, Juhi Chawla's legal counsel brought it to Justice Amit Bansal's notice that an appeal challenging the single judge order is pending before a division bench. The same will be considered on January 25. The lawyer also urged the court to defer the hearing DSLSA plea for the time being. DSLSA lawyer Saurabh Kandal told the court that the order imposing costs on Juhi Chawla was passed in June 2021 and is yet to be complied with.

He also claimed that the appeal against the single judge's order was filed only after DSLSA sent a notice to Chawla for recovery of the cost and that the division bench has not granted any stay.

The court deferred the execution plea hearing and said, "Let us see what happens before the division bench." Chawla's lawyer told the court that the single judge did not have the jurisdiction to impose costs. The DSLSA had sought "assistance" by the court by seeking issuance of warrants of attachment and sale of the properties for the recovery or directions for civil imprisonment of Juhi Chawla and others.

The plea submitted by DSLSA stated, "More than 7 months have passed since this Hon'ble court had imposed cost upon Plaintiffs (Chawla and others), which was directed to be paid within seven days to DSLSA, but the Plaintiffs have failed to deposit the cost imposed by this Hon'ble Court."

Last year, a single judge had described the lawsuit filed by Juhi Chawla and two others against 5G roll out as "defective" and called it "abuse of process of law". The judge accused Chawla and others of filing the lawsuit only to "gain publicity" and imposed a cost of ₹ 20 lakh to be deposited with DSLSA within a week. Justice JR Midha who dismissed the lawsuit said that the questions raised in it about health hazards due to the 5G technology were " not maintainable" and "stuffed with unnecessary scandalous, frivolous and vexatious averments".

Juhi Chawla had shared the video conferencing link of the hearing on her social media account which resulted in disruptions by an unknown man continued to sing songs from Chawla's movies even after repeated warnings.
