The accused, identified as Jake Henderson who is 28-year-old and Robert Cumming, 26-year-old were summoned to court on May 29. The duo will next appear at Mansfield Magistrates' Court in Nottinghamshire, East Midlands region of England, on June 29.

Chief Crown Prosecutor for CPS East Midlands Janine Smith reported that the CPS has "authorised Nottinghamshire Police to charge Jake Henderson and Robert Cumming with sending a grossly offensive message by a public communication network".

Smith added, "The function of the CPS is not to decide whether a person is guilty of a criminal offence," however, it is the court's responsibility to make appropriate, autonomous and objective assessments about whether it is appropriate to present charges to the accused.

Moreover, strict announcements are made, charging a restriction on publishing or sharing contents online that could, in any way, jeopardise the defendants' right to a fair trial.

The duo has been charged under Section 127 of the UK's Communications Act.
