The notice by Facebook mentioned it to a follow up another Facebook letter, which was sent on August 16.

The notice explained that the picture Rahul Gandhi uploaded from his Instagram handle was illegal; under the Juvenile Justice Act 2015's section 74 and POCSO Act 2012 and under Section 288A of the Indian Penal Code (IPC).

According to reports, on August 10, the National Commission of Protection of Child Rights (NCPCR) had sent the notice to Facebook.

The Correspondence said the NCPCR had noticed a video that Rahul Gandhi uploaded on his Instagram account. The identity of the minor girl's family was disclosed, which is an offence under the rule of law. The case directed Facebook to issue a removal notice for the post within three days.

However, no action has been taken by the social media platform even after three days deadline. According to Section 13 and 14 of the CRPC Act, failing to comply with the direction by the Commission, it asked Facebook to appear for a video conferencing on August 17 to explain the reason for the delay.

Ultimately Facebook replied to the order and issued notice to the Congress leader Rahul Gandhi to remove the post. After the response to the matter by Facebook, NCPCR absolved it from appearing for the explanation.

On August 7, NCPCR had also issued a similar notice to Twitter, after which the Twitter account of Rahul Gandhi was locked. Later Twitter unlocked the account when the media reports stated that the mother of the victim had given her consent to Rahul Gandhi for posting her family picture.

But in another media appearance, the victim's mother was seen expressing that she had not given her consent to publish her family picture on Twitter.
