A case has been filed against former Jammu & Kashmir Chief Minister Mehbooba Mufti by a lawyer in Jaunpur, Uttar Pradesh following her alleged seditious remarks last week. Mufti had said that the members of her party (People’s Democratic Party) would not hoist the Indian tricolour unless they are not allowed to raise the flag of Jammu & Kashmir. The flag of Jammu & Kashmir could be raised by the state in addition to the Indian tricolour until last year when the government revoked the special status granted under Article 370 of the constitution to Jammu & Kashmir.
Mufti's remarks were tantamount to treason: Lawyer
According to a report by Hindustan Times, Himanshu Srivastava, a lawyer from Uttar Pradesh, filed a case against Mufti through advocate Upendra Vikram Singh on Wednesday. He said that the former CM's remarks were "tantamount to treason" and she is yet to apologise for her seditious comments. He said that "she has allegedly tried to weaken the country and incited enmity, disharmony and hatred." According to Srivastava, the court has fixed the next date of hearing on November 27 after accepting his application.
Mufti's statement on October 23: We want J&K's flag back
On October 23, Mufti, in her first press conference after being released from her 14 months of detention on October 13, said that “We will raise the Indian Tricolour when we get Jammu and Kashmir’s flag back”. She added that until the restoration of Article 370, she won't take part in any elections. Attacking the centre, the 61-year-old said the country ought to run on the Indian constitution and according to its party manifesto.

Recently, while talking to press reporters, after she wasn't allowed to visit the Kothibagh police station where some of her party members are being detained following arrests on the grounds of trying to stage a protest on October 27, Mufti said that the government has created such an environment in the country that doesn't allow anyone to speak.
"Journalists cannot talk, civil society cannot talk, and politicians cannot talk,” she said. She added that the government's approach towards any policies is communal. She further said that they have turned "Jammu & Kashmir into a big jail."

After her release from detention on October 13, Mufti took to Twitter to share an audio message, in which she talked about the "black decision of a black day" of August 5, 2019 of revoking of Article 370. She added that no citizen of Jammu & Kazmir can forget the "humiliation" they were subjected to.
