Justice SM Modak of the Mumbai High Court made the comments while shifting a matrimonial dispute case from Pune to Mumbai at the woman's request. On August 17, after hearing two petitions from a woman and her estranged husband, Justice S. M. Modak presided over a single bench that made the decision.

On Monday, a copy of the order from August 17 was made accessible. The court ruled that because women are more vulnerable and require greater protection, their inconvenience must take precedence. The concerned couple attempted to have their matrimonial issue heard in their different cities.

According to NDTV, the wife from Mumbai requested that the Pune case be transferred to Thane, while the husband, a resident of Pune, requested that the application filed in the Thane court be transferred. The couple, who have a marriage conflict, filed two separate applications in the Thane and Pune local courts.

The guy stated in his plea that he would be unable to continue travelling to Thane since he has custody of their two minor children, who are currently being raised by his mother and sister.

In her plea, the wife claimed that because of her unemployment, she would not be able to travel to Pune. Justice Modak decided in the woman's favour, noting that the husband has his family to care for the kids and has not provided any other justification for not wishing to travel to Thane. The applicant's (wife's) discomfort must be given more consideration since the law views women as a class that belongs to the weaker segment of society and requires more protection, the court ruled.
