SC Allows Rajasthan CBSE Schools To Collect Full Fees From March

The SC has passed an interim judgement stating that the private CBSE schools can now collect full fees in the state of Rajasthan.

Rajasthan school fees: According to a recent judgment passed by the Supreme Court of India, private CBSE schools of Rajasthan are now allowed the right to collect full fees.

This fee can be paid in six equal instalments. The SC had put a stay on the previous order passed of the High Court allowing private CBSE schools to collect 70% of tuition fees. 

The bench confirmed that the private CBSE schools are entitled to collect the full fees for the academic year 2019-2020. The commencement of the fee collection would start from March 5, 2021.

SC has also mentioned certain rules which must be strictly implied by the schools to avoid any malpractices towards the students. The bench clearly mentioned that the student cannot be debarred from writing the exam of Class 10 and 12 due to nonpayment of fees. If there arises such a situation then the parents or the guardians of the ward must give an undertaking that the fees would be paid at the earliest. 

The court also announced that this judgment may change as it is an interim arrangement. And the final orders would be passed after the next hearing. The interim order will not prejudice the rights and contentions of the parties.

Even though the fees for the academic year can be paid in instalments, the fees for 2020-2021 is independent of any such compulsion.

The state of Rajasthan is further directed to clear the outstanding arrears with respect to the unit costs of private schools, which cover the costs borne by such schools to teach the 25% of students belonging to Economically Weaker Sections as mandated by the Right to Education Act, within one month.

The bench of Justice Dinesh Maheshwari and others heard the petitions filed by private CBSE schools challenging the judgement of the High Court dated December 18, 2020, for collecting 70% of fees only. Rajasthan school fees
