Netflix Premieres Indrani Mukerjea Series As Court Junks CBI Plea

Netflix documentary "The Indrani Mukerjea Story: Buried Truth" cleared the legal roadblocks after the Bombay High Court passed a green flag for the series to air. The series was released on Thursday at the streaming platform.

The Bombay High Court found itself at the epicenter of a legal tussle as the Central Bureau of Investigation (CBI) sought to previously halt the documentary's streaming, citing concerns over its potential influence on ongoing judicial proceedings. However, after a rigorous evaluation, the court ruled in favor of the documentary's release, dismissing the CBI's petition and allowing audiences a glimpse into the turbulent events that transpired. Originally slated for a premiere on February 23, the release was temporarily halted due to the CBI's intervention.

Legal Tug of War

The Bombay High Court, with Justices Revati Mohite Dere and Manjusha Deshpande presiding, recently posed inquiries regarding the rights of the prosecution and the victim in the ongoing case. Emphasizing the importance of transparency, the court, in the latest proceedings, urged Netflix  to grant CBI officials access to the documentary. It asserted that, similar to the rights accorded to the accused, both the prosecution and the victim should be recognized for their rights. The CBI , in its petition, requested the court withhold the release of the Netflix docuseries until the conclusion of the case trial. The basis for this request was the concern that the series could potentially influence the ongoing court proceedings.

However, the court adjourned by overruling the petition, giving green flags to the OTT platform for the documentary's release, which aired on the streaming platform on February 29. 

Netflix's Stand and Court's Response

Netflix, represented by Senior Advocate Ravi Kadam, initially resisted the idea of a pre-screening, citing concerns about pre-censorship. Kadam contended that the CBI should have approached the court at an earlier stage. However, the court, which previously underlined that the trial is still underway, suggested a modest delay in the release, claiming that "heavens are not going to fall."

During the course of the proceedings, Netflix's legal counsel, Kadam, revealed that the documentary would not be released before the next court hearing. He informed the court that the series features interviews with five key witnesses, including Indrani's son Mikhail and Vidhie Mukerjea, her daughter from her second husband, Peter Mukerjea, aiming to balance the interests of all parties involved in the case.

The Sheena Bora Murder Case Timeline

The documentary delves into the infamous Sheena Bora murder case, where Sheena was allegedly strangled to death in a car in April 2012. Indrani Mukerjea, along with her then driver Shyamvar Rai and former husband Sanjeev Khanna, stand accused in the case.

April 24, 2012: Mysterious Departure

Sheena Bora takes leave from her job under mysterious circumstances. Media reports suggest resignation, but her family contends she went abroad for further studies, precluding the filing of a missing person complaint.

May 23, 2012: Discovery of a Tragedy

A month later, police discovered Sheena Bora's lifeless body in Maharashtra's Raigad district, sparking a cascade of events that would unfold over the years.

August 2015: Arrests and Confessions

Three years after the grim discovery, Indrani Mukerjea is arrested for her daughter's murder. Her ex-husband, Sanjeev Khanna, and the driver, Shyam Rai, also confess to complicity. Rai admits to the murder and implicates both Indrani and Khanna.

September 2015: Paternity Claims

Kolkata resident Siddhartha Das, Indrani Mukerjea's former partner, asserts himself as Sheena Bora's biological father. The case transitions to the CBI, which files an FIR against Mukerjea, Khanna, and Rai.

November 2015: Peter Mukerjea's Arrest

Peter Mukerjea, Indrani's third husband, gets arrested by the CBI, which alleges that both Mukerjeas played equal roles in a conspiracy to eliminate Sheena due to her relationship with Rahul.

2016–2017: Legal Proceedings

The CBI files chargesheets against Indrani, Peter, and Khanna. The trial commences, with charges including conspiracy, kidnapping, destroying evidence, giving false information, and, notably, murder.

2019-2022: Legal Developments

Indrani and Peter Mukerjea's relationship ends in divorce. Peter is granted bail in 2020. Indrani's repeated bail pleas were rejected until the recent Supreme Court decision in May 2022, citing her significant time spent in custody.

While the legal battle ensues, the fate of The Indrani Mukerjea Story: Buried Truth hangs in the balance.
