Teen's Rapist Gets Life Term; Rs 10 Lakh Compensation For Survivor

A 13-year-old's rapist has been awarded life imprisonment by a Delhi sessions court. His accomplice has been jailed for 10 years. The survivor will get compensation of Rs 10 lakh.

The court observed that it is these crimes that make the capital unsafe for women and children on the streets. It also said that these crimes also restrict them from using their fundamental right of freedom of movement.

"This is most heinous nature of offence, which has not only caused lifelong trauma and scar on the mind of the minor, but also shaken conscience of the society"

"Such offence has not only left a deep scar on the survivor, but also made women and children unsafe on the road which encroaches upon their fundamental right of freedom of movement," it added.

Additional Sessions Judge Gurdeep Singh said that both the convicts, Gaurav and Harish, residents of northeast Delhi, will pay the compensation amount equally.

However, Advocate Shabnam Khan, counsel for Delhi Commission for Women, had asked for higher compensation given the Delhi Victim Compensation Scheme, 2015.

"Keeping in view the age and the economic conditions of the survivor, the effect which the crime has made on her and the physical and mental trauma and injury on the private parts she suffered ... I am of the opinion that the survivor holds right to compensation. I grant compensation to the tune of Rs 10 lakh, which would be adequate for rehabilitation," the court said

The girl received justice after five years of filing the case. Harish and Gaurav had kidnapped and raped her on February 9, 2012. The two claimed that they were innocent. They victim-shamed her by saying that she was with a boy. However, the two convicts failed to produce any evidence to substantiate their claims.
