The Supreme Court ruled that the exclusion of unmarried women who conceive out of a live-in relationship from the Medical Termination of Pregnancy (MTP) Rules is unconstitutional.

Every woman’s right to access abortion is intertwined with her sexual rights and that should have nothing to do with her marital status.

If an unmarried girl becomes pregnant because of failure of a protective device, why should she be deprived of the benefits already given to certain categories of women: Supreme Court of India.

The bench said, “We will not permit you to kill that child… Give the child to somebody in adoption. Why are you killing the child?”

The report submitted by the six doctors panel ruled that the foetus suffers from ‘high mortality’ heart condition. 

The court took the decision after doctors advised that cosmetic surgery could easily treat the foetus’ deformities – cleft lip and palate.

It is a sad reality that women citizens of the first world countries also struggle in getting in getting basic human rights allotted to them. We will have to wait and watch to see how the situation proceeds.

The 17-year-old survivor had submitted a plea stating that her mental and physical health was at risk from the pregnancy.

The decision regarding whether to continue a pregnancy or terminate it, should fundamentally be the decision of a woman and Indian judiciary ensures that.
