Why Delay In Nirbhaya Convicts’ Hanging? DCW Asks Tihar Jail

This December, it will be five years since the brutal gangrape and death of Jyoti Singh aka Nirbhaya. The Delhi Commission for Women (DCW) has therefore written to the Tihar Jail authorities and the DCP, South District, about the delay in hanging of the convicts.

The Supreme Court upheld the death sentence of the convicts six months ago. Yet, Tihar jail authorities have not acted upon the verdict.

DCW chief Swati Malliwal sent the notice, knowing that the convicts can opt for a review of the SC judgment. The convicts can also file for curative petition and seek mercy from the President after exhausting judicial remedies.

Nirbhaya’s mother had complained to DCW that even after five months of SC’s verdict, Tihar jail has not taken any action upon it. Following this, the DCW chief sent a notice to the jail authorities seeking a response, said a statement from the commission.

“It is a shame that even Nirbhaya is yet to receive justice in our country. Nirbhaya’s mother and the entire nation are pleading for justice. She said that the jail authorities must hang the convicts at the earliest,” stated Malliwal in her letter

On May 5, the SC had upheld the death sentence for four men convicted in the Nirbhaya case. The apex court called the attack "most brutal, barbaric and diabolical".

Malliwal, in her notice, has asked the authorities to respond to the letter by November 6. “It is a shame that even Nirbhaya is yet to receive justice in our country. Nirbhaya’s mother and the entire nation are pleading for justice. She said that the jail authorities must hang the convicts at the earliest,” stated Malliwal in her letter.

The four convicts in the Nirbhaya rape case are Mukesh (29), Pawan (22), Vinay Sharma (23) and Akshay Kumar Singh (31). The fifth convict, Ram Singh, allegedly committed suicide while in the jail. The sixth convict, who was a juvenile at the time of crime, was sent for three years of punishment in a reform home. The court released him in 2015.
