Allahabad HC Dismisses Plea Filed To "Defame Woman And Get Her Custody"

Allahabad HC dismissed the petition of a man as he tried to defame a married woman and claimed to have married her.

Allahabad HC has dismissed the plea of a man on the ground of defaming the woman and trying to get her custody through the petition.

Justice Shamim Ahmed heard the plea of a man requesting the custody of a woman who was allegedly detained by her father and had claimed to have married her. The man is identified as Dharmendra and is the Petitioner 2 in the case. Petitioner 1 is the woman Dharmendra claims to have married, Netriwati Yadav.

Netriwati Yadav was presented in front of the court along with her father. She denied all claims of the man named Dharmendra stating that she isn't married to him. Yadav's father said that he has wed his daughter to Banti according to the Hindu rituals.

Yadav alleged that Dharmendra comes to her village to visit his sister who is married there. On his visits, the man regularly teases her, she claimed. She alleged that Dharmendra's petition is filed in order to defame her. She also mentioned the fact that she is already married to someone else.

After hearing the arguments presented by both sides, the court dismissed the petition filed by Dharmendra. He is also required to pay the cost of Rs 50,000 to Netriwal Yadav on the grounds of trying to defame her.

The court said in its statement," The action of petitioner no.2 is illegal and against the norms of society in which we are living. As per the statement of petitioner no.1 and her father Sri Tejpal, she is married with one Banti who also accompanied her in the High Court campus. (sic)"

"Accordingly, the writ petition is dismissed with cost of Rs.50,000/- (rupees fifty thousand) which shall be paid by petitioner no.2 Dharmendra to petitioner no.1 Netrawati Yadav by way of bank draft within one month from today," the court added.
